{"id":2322,"date":"2021-10-02T11:00:56","date_gmt":"2021-10-02T09:00:56","guid":{"rendered":"https:\/\/comeup.com\/experts\/?p=2322"},"modified":"2023-11-13T10:35:11","modified_gmt":"2023-11-13T09:35:11","slug":"linpi-et-le-depot-dune-marque-en-bref","status":"publish","type":"post","link":"https:\/\/comeup.com\/experts\/linpi-et-le-depot-dune-marque-en-bref\/","title":{"rendered":"L&rsquo;INPI et le d\u00e9p\u00f4t d&rsquo;une marque en bref"},"content":{"rendered":"<p>Pendant plus de cent ans, on a constat\u00e9 tr\u00e8s peu d\u2019\u00e9volutions dans le droit des marques, issu de la loi\u00a01857. Cette derni\u00e8re \u00e9tait le texte fondateur des droits d&rsquo;une marque en France. Une \u00e9poque o\u00f9 le commerce \u00e9tait en pleine expansion et durant laquelle il \u00e9tait important de prot\u00e9ger les commer\u00e7ants. Le texte a permis \u00e0 une marque de rev\u00eatir 3 formes : la d\u00e9nomination, un embl\u00e8me (comme un <a href=\"https:\/\/comeup.com\/categorie\/logos?utm_source=blog&amp;utm_medium=article&amp;utm_campaign=art021021INPI\" target=\"_blank\" rel=\"noopener\">logo<\/a>) et un signe distinctif. Malgr\u00e9 cela, on constatait que la l\u00e9gislation en vigueur pr\u00e9sentait des imperfections \u00e9videntes. Heureusement, l\u2019ordonnance de la loi PACTE a permis d\u2019apporter des changements sur la protection des marques dans l\u2019Union europ\u00e9enne (UE). D\u00e9couvrez, dans cet article les diff\u00e9rents aspects de l\u2019INPI et du d\u00e9p\u00f4t de marque.<\/p>\n<h2>Le d\u00e9p\u00f4t de marque au XXI\u00e8me si\u00e8cle<\/h2>\n<p>De nos jours, en plus de pouvoir r\u00e9aliser un d\u00e9p\u00f4t de marque aupr\u00e8s de l\u2019INPI, il est d\u00e9sormais possible d\u2019annuler totalement ou partiellement une marque d\u00e9ceptive, devenue g\u00e9n\u00e9rique ou non-exploit\u00e9e depuis plus de cinq ans. Une marque d\u00e9ceptive est\u00a0\u00ab de nature \u00e0 tromper le public, notamment sur la nature, la qualit\u00e9 ou la provenance g\u00e9ographique du produit ou du service \u00bb. Une marque g\u00e9n\u00e9rique est une marque comme Caddie ou Frigidaire. C&rsquo;est une marque dont le nom devient aux yeux du consommateur le nom m\u00eame du produit. Si une marque est, selon un juge, devenue g\u00e9n\u00e9rique, elle devient libre de droit et ses concurrents peuvent l&rsquo;utiliser.<\/p>\n<p>D\u2019ailleurs, le recours \u00e0 ce genre de contentieux est \u00e0 la fois facile, rapide et moins co\u00fbteux. Sans compter le fait que vous n\u2019avez pas besoin de faire une d\u00e9monstration pr\u00e9alable d\u2019un int\u00e9r\u00eat \u00e0 agir devant l\u2019Institut national de la propri\u00e9t\u00e9 industrielle (INPI).<\/p>\n<p>L\u2019INPI renforce \u00e9galement son contr\u00f4le sur les preuves d\u2019usage qui sont soumises dans le cadre d\u2019une proc\u00e9dure d\u2019opposition. Pour les d\u00e9marches d\u2019oppositions entreprises depuis 2019 \u00e0 l\u2019encontre d\u2019une demande d\u2019enregistrement, l\u2019opposant qui a enregistr\u00e9 la marque depuis plus de 5 ans doit, sur demande du d\u00e9posant, \u00eatre en mesure de fournir des preuves d\u2019exploitations pertinentes. Et cela sur chacun des produits et services cit\u00e9s \u00e0 l\u2019appui de l\u2019opposition.<span class=\"Apple-converted-space\">\u00a0<\/span><\/p>\n<p>Si une entreprise souhaite d\u00e9poser une marque, elle doit forc\u00e9ment passer par l&rsquo;INPI. Elle doit pr\u00e9voir de d\u00e9bourser 190\u00a0\u20ac pour un d\u00e9p\u00f4t et 290\u00a0\u20ac pour un renouvellement. D\u00e8s la seconde classe, des taxes additionnelles sont exig\u00e9es. Ils sont plafonn\u00e9s \u00e0 40\u00a0\u20ac par classe. Gr\u00e2ce \u00e0 ce changement, les d\u00e9posants ne chercheront plus qu\u2019\u00e0 prot\u00e9ger les produits et services qui leur seront r\u00e9ellement n\u00e9cessaires.<span class=\"Apple-converted-space\">\u00a0<\/span><\/p>\n<p>Pour information, lors d&rsquo;un d\u00e9p\u00f4t de marque, il faut \u00e9galement d\u00e9clarer dans quelle cat\u00e9gorie cette derni\u00e8re correspond (services ou produits). C&rsquo;est ce qu&rsquo;on appelle les classes de d\u00e9p\u00f4t (identifi\u00e9es par la classification internationale de Nice). Il en existe au total 45, parmi lesquelles nous pouvons citer : appareils et instruments chirurgicaux, m\u00e9dicaux ; joaillerie ; bijouterie, pierres pr\u00e9cieuses ; mat\u00e9riaux de construction non-m\u00e9talliques ou encore t\u00e9l\u00e9communications.<\/p>\n<h2><b>Les titulaires de marques profitent d\u2019une meilleure d\u00e9fense de leurs droits<\/b><\/h2>\n<p>D\u00e9sormais, il est possible d\u2019invoquer plusieurs droits ant\u00e9rieurs \u00e0 l\u2019appui d\u2019une seule et m\u00eame proc\u00e9dure d\u2019opposition. Comme fondement d\u2019opposition, il est donc possible d\u2019invoquer l\u2019atteinte \u00e0 une marque renomm\u00e9e ant\u00e9rieure. Il en est de m\u00eame pour un nom de domaine, un nom commercial ou une enseigne pouvant provoquer une confusion dans l\u2019esprit du public. M\u00eame cas en ce qui concerne la raison sociale ou la d\u00e9nomination qui risque de semer le trouble aupr\u00e8s du public.<span class=\"Apple-converted-space\">\u00a0<\/span><\/p>\n<p>Le nom et la renomm\u00e9e des \u00e9tablissements publics de coop\u00e9ration intercommunale peuvent \u00e9galement faire l\u2019objet d\u2019une opposition. Tout comme le nom d\u2019une entit\u00e9 publique, s\u2019il existe un risque de confusion dans l\u2019esprit du public. Dans tous les cas, cette \u00ab\u2009nouvelle\u2009\u00bb proc\u00e9dure d\u2019opposition peut se faire uniquement \u00e0 l\u2019encontre des demandes d\u2019enregistrement de marques. Par ailleurs, depuis le 2020, une proc\u00e9dure administrative en nullit\u00e9 est mise en place devant l\u2019INPI.<\/p>\n<p>Une marque peut \u00eatre consid\u00e9r\u00e9e comme nulle si elle est par exemple d\u00e9pourvue de caract\u00e8re distinctif,\u00a0d\u00e9crit des produits et\/ou services d\u00e9sign\u00e9s, de nature \u00e0 tromper le public ou si elle porte atteinte aux droits d\u2019un tiers.
